If we are unable to fill your order due to crop failure or damage by natural causes we reserve the right to refund all or any part of payment. Our varieties are true to name and will be replaced upon proper proof, free of charge, or a refund of original purchase price at our discretion.
All items are sold "as is" and "with all faults". All warranties, expressed and implied, including any implied warranty of merchantability, or fitness for a particular purpose, are hereby expressly disclaimed by the seller. Once delivered to and accepted by Buyer, Buyer acknowledges and accepts the entire risk as to growth quality and performance of cuttings, runners or plants. Buyer expressly agrees that any and all damages arising out of this contract shall be limited to the purchase price of the goods purchased.
All claims must be submitted within 30 days of receipt of plants.
